In the name of God Amen. I Philip Brenner of East Donegal Township in the County Of Lancaster and State of Pennsylvania, farmer, being advanced in years to an old age, and being sickly and weak in body, but of sound mind, memory and understanding (blessed be God for the same) and considering the uncertainty of this transitory life, do make and publish this my last Will and Testament in manner and form following, to wit:
Principally, and first of all, I commend my immortal soul into the hands of Almighty God, who gave it, and my body to the earth to be buried in a decent and Chistian manner at the discretion of my executors hereinafter named; and as to such worldly estates wherewith it hath pleased God to bless me in this life I give and dispose of the same as follows:
First, it is my will and I order and direct that my just debts and funeral expenses be duly paid and discharged hereinafter named out of such of my estate as may then come to their hands.
Item: I give and bequeath unto my daughter Polly, all that house tenement and four lots of ground which I have lately bought from Henry Rhone, situated in the town of Springville in Dougal Township and County of Lancaster aforesaid, to hold the same to her by my said daughter Polly and to her heirs and assigns forever, and I value and appraise the same at and for the sum of five hundred and five dollars, being the purchase money I have paid for the said house and four lots of ground the same to be counted as part of her share and portion coming unto her out of my estate.
Item: I give and bequeath unto my grandaughter Fanny Delbow, the sum of five hundred dollars, the same to be paid to her by my executors, when she becomes twenty one years of age or on the day of her marriage which ever may take place first, and the said five hundred dollars are to be paid to my said grandaughter Fanny Delbow, out of the share and portion of my daughter Hanna (her mother) within named.
Item:My will is and I order and direct, that my Plantation land and farm where I now live, situated in Donegal Township aforesaid and my land and farm in Mount Joy Township, together with my stock, farming implements and household furniture, be sold by my executors herein named, within one year after my decease or as soon thereafter as conveniently can or may be done whether at public or at private sale, as to them may seem best; and the monies and neat proceeds arising out of the same together with all my other estate real and personal, monies, bonds and effects not otherwise herein bequeathed, whatsoever I may die possessed of, I order and direct and it is my will, that the same be divided amongst and paid to my children and grandchildren herein after named as to their legal representatives, in manner following: That is to say, to my son Philip three thousand one hundred and sixty six and to my daughters Polly, Elizabeth, Susanna, Barbara and Hanna, three thousand one hundred and sixty six dollars each and to my grand children John Eichholz and Catharine Eichholz (In right of their late mother Catharine deceased) the like sum of three thousand one hundred and sixty six dollars to be shared, including such sums, goods and articles, as they and every one of them have had and received from me in my lifetime; and having respecy also to the share of Polly's as to include in the sum and in her share, the house, tenement and four lots of ground within and above mentioned, valued at $500 dollars as within bequeathed to her daughter Fenny Delbow is to be charged to and taken out of her share; And whereas my son Michael having had and received the like sum of $3166. from me some time ago by the way of the land and farm where he now lives . Now my will is and I order and direct, that the balance or overplus of my estate (if any) be paid over in equal shares (as soon as can be done) to my sons, Michael and Philip, and to my daughters, Polly, Elizabeth, Susanna, Barbara and Hanna, and to my grandchildren John and Catharine aforesaid dec. So that they may have and get share and share alike, having still respect to and including such sums and articles as they have had and received from me in my lifetime.
And whereas John Walter who is intermarried with my said grand daughter Catharine Eicholtz is appearingly indulging himself in the worst of evils and bad habits of taking spiritual liquar to excess, therefore my will is and I do hereby order and direct that my executors shall hold and retain in their hands, the money share and portion, coming to the said Catharine, out of my estate, as mentioned above, to hold or put out the same on interest or to lay it out in real estate, as they may think most advisable and not to pay the same or any part thereof to the said John Walter, unless he becomes a sober, orderly and well doing man for his wife and family. And as to Philip Bailor who was intermarried with my Daughter Polly within named, and who some time ago deserted her, left her and children peniless and in great distress and have taken up with some other woman, as report says. Therefore my will is that the said Philip Bailor if yet living, shall be excluded and forever banned against any claim of my estate, in right of the said Polly or otherwise whatsoever.
And lastly I nominate, constitute and appoint my said son Michael Brenner and my son-in-law Henry Mayer, to be Executors of this my will, giving and granting unto them, full power and authority to execute the same, according to the true intent and meaning thereof and also what they or the survivor of them, sign seal and executeDeed or Deeds of conveyance for my land and farm, to the purchasers thereof, ( when sales are effected), and to their heirs and assigns and also to make a Deed to my daughter Polly and to her heirs and assigns, for the house, tenement and four lots of ground, mentioned and bequeathed to her (if not done in my lifetime) which Deeds of conveyance so made and done shall be held and deemed as good and binding in law, as if I had done and executed them personally in my lifetime, hereby revoking all other wills, legacies and bequeathes by me heretofore made and declaring this and no other to be my last Will and Testament.
